Does a New York Health Care Proxy need a notary?

The official New York Health Care Proxy form generally calls for two adult witnesses, not notarization. Adding a notary is not a substitute for the required witnesses.

Use the current form and instructions from the New York State Department of Health. If a hospital, another state, or a separate document asks for notarization, find out exactly which signature and notarial act it requires before booking.

Before signing

  • Read the official instructions.
  • Arrange two eligible adult witnesses.
  • Check the special restrictions on who may serve as a witness.
  • Ask the receiving institution whether it has its own form or additional requirements.
  • Speak with a qualified professional if you need advice about choosing an agent or the legal effect of the form.

I do not add a notarial certificate merely because someone would like a stamp. A notarial act should be required by the document or a reliable instruction from the recipient or preparer.
