Proof of execution by a subscribing witness

Proof of execution is a specialized procedure used in limited circumstances when a subscribing witness—not the original signer—appears before the notary and gives sworn testimony about the document’s execution.

It is not a convenient replacement for the signer’s personal appearance. The document type, witness, identity evidence, and statutory requirements must all support the procedure. Some documents cannot use this method.

Before relying on proof

  • Ask the recipient or document preparer whether New York proof of execution is permitted and acceptable.
  • Confirm that the witness actually qualifies as a subscribing witness.
  • Gather the required identity evidence.
  • Do not assume the procedure can be completed online or used for every document.

I will review the request before scheduling and may decline if any required element is uncertain or missing.

Compare all notarial acts or send the basic details of your request.
