A foreign civil registry, court, or other recipient may ask for a U.S. divorce judgment when you remarry, update family records, or deal with another matter abroad. First confirm whether it needs the full judgment, a divorce certificate, or another court document. These are not interchangeable.
Start with the issuing court or records office
A plain photocopy or a file downloaded from a case portal may lack the certification needed for an apostille. Ask the court clerk for the certified record required for foreign use and whether additional certification or exemplification is needed for that document’s route.
In New York County, access to matrimonial case files is restricted. The court’s instructions identify parties and their attorneys as people entitled to obtain the records with proper identification. Other counties have their own request procedures. You must obtain the authorized court copy yourself; I do not retrieve divorce records or act as your legal representative.
Do not add a notary stamp to a photocopy as a substitute for the clerk’s certified copy. An apostille on a separate affidavit about a copy would authenticate that notarized statement, not the court’s original judgment.
Which authority issues the apostille?
For a qualifying New York court record, the route ends at the New York Department of State after the required certifications. A judgment from another state follows that state’s rules. A federal court document requires a separate check of the issuing clerk’s certification and competent authority; do not assume the New York route applies.
The recipient abroad decides whether the judgment is sufficient to establish the fact or legal effect of the divorce. Apostille processing does not include advice about remarriage, recognition, custody, property, or support.
Timing starts after the record is ready
Obtaining a certified or exemplified court copy can take additional time before apostille processing begins. Manhattan rush handling is considered only after review of a complete eligible package. A document that needs another county’s or another state’s work may require a longer route.
For apostille assistance, tell me the issuing court and state, document type, country of use, and deadline. Avoid describing private family matters in ordinary messages. Securely upload a copy for practical review, or contact me first.
